23rd Feb: Kashmiri Women’s Resistance Day
30 years after numerous Kashmiri women complained of the horrifying mass rape and torture by the Indian Armed Forces at Kunan Poshpora, the survivors continue to struggle for justice.
In the intervening time, 6 of the survivors and witnesses have died, but the others, as well as survivors of other militarized gendered violence continue to resist and refuse to be victimized and shamed into silence.
We commemorate the 23rd February, Kashmiri Women’s Resistance Day, in commitment to amplify Kashmiri women’s voices and speak out against the impunity from legal processes that state forces have, which enables targeted sexualized violence on women’s bodies as a tool of reprisal against Kashmiri ‘insurgency’.
In a context of armed conflict, occupation and militarization, cases of rape and torture continue to pile up every day, with more than 10% of women in Kashmir reporting being subjected to (repeated) sexual violence. Now even more, with the abrogation of Article 370, there is an added layer of oppression, increased surveillance and militarization.
We deplore the denial of rights, recognition, choice, agency and justice to Kashmiri women and gender non-conforming persons, in legal processes geared to provide impunity; as well as in media reporting, presenting them largely as ‘victims’ in need of saving. We acknowledge the need to hear out and engage with Kashmiri women’s own articulation of struggle in interconnected issues, including resistance against corporate land alienation, resource loot and demanding just development policies and forest rights, along with bringing an end to the culture of erasure and lack of accountability for all state excesses, including enforced disappearances.
NAPM stands in solidarity with the aspirations and resistance of Kashmiri women, undaunted over years and years, in their fight for justice, dignity and freedom from occupation, state repression and sexual violence.
23 फरवरी: कश्मीरी महिला प्रतिरोध दिवस
भारतीय सशस्त्र बलों द्वारा अनेक कश्मीरी महिलाओं के सामूहिक बलात्कार और यातना की शिकायत के 30 साल बाद भी पीड़ित महिलाओं का न्याय के लिए संघर्ष जारी है।
बीते समय में 6 महिला गवाहों की मृत्यु हो चुकी है, लेकिन बाकी लोगों, जिनमें सैन्य यौनिक हिंसा के पीड़ित शामिल हैं, वे किसी शर्म या उत्पीड़न का हवाला देकर चुप नहीं किये जा सके हैं। उनका प्रतिरोध लगातार क़ायम है।
हम 23 फरवरी को कश्मीरी महिला प्रतिरोध दिवस के रूप में स्मरण करते हैं। हम प्रतिबद्ध हैं कश्मीरी महिलाओं की आवाज़ों को और बुलंद करने के लिए और क़ानूनी प्रक्रियाओं से शासन-तंत्र को हासिल दंड-मुक्ति के ख़िलाफ़ आवाज़ उठाने के लिए। इस प्रकार दंड के अभाव में महिलाओं पर लैंगिक हिंसा को कश्मीरी ‘उग्रवाद’ के ख़िलाफ़ इस्तेमाल होने वाला एक उपकरण बना दिया गया है।
सशस्त्र संघर्ष, कब्ज़े और सैन्यीकरण के संदर्भ में बलात्कार और यातना के मामले दिन-ब-दिन बढ़ रहे हैं। कश्मीर में 10 फीसदी से अधिक महिलाएं को (लगातार) लैंगिक हिंसा का सामना करना पड़ता है। धारा 370 के निरस्त होने के बाद उत्पीड़न, निगरानी और सैन्यीकरण की एक परत और बढ़ गयी है।
कानूनी प्रक्रियाओं में दंड के अभाव की इस व्यवस्था के कारण कश्मीरी महिलाओं और जेंडर मानकों से मुक्त व्यक्तियों के अधिकारों, स्वीकृति, चुनाव, एजेंसी और न्याय की अवहेलना का हम पुरजोर विरोध करते हैं। साथ ही मीडिया रिपोर्टिंग में मात्र ‘पीड़ितों’ के रूप में उनकी प्रस्तुति की भी निंदा करते हैं। हम कश्मीरी महिलाओं द्वारा अपने संघर्ष की मुखर अभिव्यक्ति को सुनने की आवश्यकता को समझते हैं, जिसमें तमाम संघर्ष जैसे कॉर्पोरेट जमीन अधिग्रहण और प्राकृतिक संसाधनों की चोरी का विरोध; न्यायपूर्ण विकास नीतियों और वन अधिकारों की मांग; और सरकारी-तंत्र की हिंसा, लोगों के गायब होने आदि पर जवाबदेही मांगना शामिल हैं।
कश्मीरी महिलाओं की आकांक्षाओं और वर्षों से चले आ रहे न्याय, सम्मान, कब्ज़े से मुक्ति, राज्य-दमन और लैंगिक हिंसा के ख़िलाफ़ निडर प्रतिरोध के साथ NAPM एकजुटता में खड़ा है।
